1. Intellectual property objects
1.1. All intellectual property placed on and related to the WoW Brain platform belongs to WoW Brain Ltd (hereinafter — the «Rightholder»), unless expressly stated otherwise.
1.2. The Rightholder's intellectual property objects include:
- the source code of the platform (frontend, backend, mobile PWA application, server algorithms);
- the design — graphical interface, iconography, typography, visual style;
- the databases — structure and content (test questions, trainer inventory, learning content, methodologies);
- the texts — descriptions, articles, course materials, documentation;
- audio and video materials, images, illustrations, video lectures;
- Logos and the WoW Brain brand mark (the Fibonacci spiral);
- Names: «WoW Brain», «NeuroCognitive Operating System», «Institute Internativa», «Neuro-Probe», «Atlas of Goals»;
- the methodologies of neurocognitive assessment and training developed by the Institute «Internativa» since 2006.
2. Trademarks and protected designations
2.1. The Rightholder declares the use of the following designations as trademarks:
- «WoW Brain»™ — a word designation used as the name of the platform since 2024;
- «NeuroCognitive Operating System»™ — a word designation used to identify the concept and product category;
- the Fibonacci spiral in its branded form — a graphic designation used in the logo since 2024;
- «Institute Internativa»® — the name of the Rightholder, used since 2006.
2.2. The Rightholder registers the said designations as trademarks in the established manner (Rospatent, WIPO for international protection). Until registration is completed, the designations are protected by the rules of fair competition and by copyright in the original works.
2.3. Any commercial use of the said designations and of designations confusingly similar to them by third parties without the Rightholder's written permission constitutes an infringement.
3. Strictly prohibited
3.1. Without the Rightholder's written consent, it is prohibited to:
- copy, distribute or publish any materials of the Platform;
- create clones of the Platform or similar services under similar names;
- use the names «WoW Brain», «NeuroCognitive OS», «Institute Internativa», «Neuro-Probe» in your own products, domains, social media accounts or marketing materials;
- modify, decompile or disassemble the source code;
- perform mass automated data collection (scraping, parsing), except via the official public API;
- extract test questions, exercises or content for use in competing products;
- use the Platform's materials in educational or commercial programs without attribution and without concluding a license agreement.
4. License granted to the User
4.1. For the duration of an active account, the User is granted a simple (non-exclusive) license to use the Platform for personal purposes or the purposes provided for by the organization's plan.
4.2. The license does not grant the right to:
- transfer access to third parties in circumvention of the plan terms;
- extract or copy the databases;
- create derivative products;
- commercially use the content outside the Platform.
4.3. The license terminates upon termination of the account or the end of the paid period (for paid features).
5. Rights in user-generated content
5.1. Content created by the User while using the Platform (test answers, goals, notes, records) is the property of the User.
5.2. The User grants the Operator a non-exclusive, royalty-free license to use such content for the purpose of providing the services and improving the quality of the Platform in anonymized, aggregated form.
6. Infringement notice procedure
6.1. If you believe that material infringing your rights has been placed on the Platform, send a notice to support@wow-brain.com specifying:
- a description of the work whose rights are infringed;
- the exact URL of the disputed material on the Platform;
- the rightholder's contact details and proof of rights;
- a statement that the use is carried out without permission and in violation of the law.
6.2. The Operator will review the notice within 14 business days. If justified, the disputed material is blocked or removed.
7. Enforcement measures for infringement of the Rightholder's rights
7.1. Upon discovering an infringement, the Rightholder may:
- send the infringer a demand to cease the infringement and remove the materials;
- contact the hosting provider and the domain registrar;
- file a complaint with Roskomnadzor to have the resource blocked;
- apply to a court to stop the infringement, recover damages or claim compensation under Art. 1252, 1301 of the Civil Code (from 10,000 to 5,000,000 rubles);
- file for administrative (Art. 7.12 of the Code of Administrative Offenses) or criminal (Art. 146 of the Criminal Code) liability.
8. Governing law
8.1. All intellectual property matters are governed by Part IV of the Civil Code.
8.2. At the international level, the Rightholder protects its rights in accordance with the Berne Convention for the Protection of Literary and Artistic Works and the Paris Convention for the Protection of Industrial Property.
