User Agreement

1. General provisions

1.1. This User Agreement (hereinafter — the «Agreement») governs the relationship between WoW Brain Ltd (hereinafter — the «Operator», «We») and any individual or legal entity using the WoW Brain platform hosted at https://wow-brain.com and the related services (hereinafter — the «Platform», «Service», «WoW Brain»).

1.2. Using the Platform constitutes the User's unconditional agreement to all the terms of this Agreement. If you do not agree with any of its provisions, you must stop using the Service.

1.3. The Operator reserves the right to unilaterally amend this Agreement. The current version is always available at https://wow-brain.com/legal/terms.

2. Terms and definitions

• The WoW Brain platform — a software and hardware complex comprising the website, mobile application (PWA), server infrastructure, databases, learning materials, neuropsychological trainers, tests and artificial intelligence algorithms.
• User — an individual or legal entity that has registered an account on the Platform.
• Account — the User's account, protected by a login (email) and a password.
• Platform Content — the source code, design, texts, images, audio and video materials, question banks, testing methodologies and names placed on the Platform.
• User Content — data added by the User (test answers, personal goals, notes, etc.).

3. Registration and account

3.1. To use the full functionality of the Platform, you must register an account by providing a valid email and setting a password.

3.2. The User undertakes to provide accurate information and keep it up to date.

3.3. The User is responsible for keeping their password secure and for all actions taken from their account. Any unauthorized access must be reported immediately to support@wow-brain.com.

3.4. Registration is available to persons who have reached the age of 18. Use of the Platform by persons under 18 requires the consent of their legal representatives.

4. Plans and payment

4.1. The Platform provides both free and paid features. The current list of plans is published at https://wow-brain.com/pricing.

4.2. Payment is made under the terms set out in the Public Offer.

4.3. Refund conditions are described in the Refund Policy.

5. Intellectual property

5.1. All exclusive rights to the Platform Content, including the source code, graphical interface, databases, testing methodologies, learning materials, the «WoW Brain» name, the term «NeuroCognitive Operating System» and the related trademarks, belong to the Operator.

5.2. The User is granted a limited, revocable, non-exclusive right to use the Platform strictly for personal purposes or the purposes provided for by the plan.

5.3. Without the Operator's written consent, it is strictly prohibited to:

• copy, modify, decompile or disassemble the Platform's source code;
• create derivative products based on the Platform Content;
• use the names «WoW Brain», «NeuroCognitive Operating System» and confusingly similar designations in your own products, domain names or marketing materials;
• carry out scraping, mass automated data extraction, or reverse engineering of the trainers and tests;
• share access to your account with third parties in circumvention of the plan terms.

6. User Content

6.1. The User retains all rights to the data they upload (goals, notes, test answers).

6.2. The User grants the Operator a non-exclusive, royalty-free license to use the User Content solely for the purpose of providing the services (storage, display, analytical processing for personalization) and, in anonymized form, to improve the quality of the service.

7. Prohibited actions

7.1. When using the Platform, it is prohibited to:

• violate the current applicable law;
• distribute illegal, offensive, extremist or erotic content;
• disrupt the Platform (DoS attacks, exploiting vulnerabilities, injections);
• create multiple accounts to circumvent plan limits;
• impersonate another person or a representative of the Operator.

7.2. For a violation, the Operator may restrict access, block the account without refunding payments, and contact law enforcement authorities.

8. Liability of the parties

8.1. The WoW Brain platform is not a medical service and does not replace consultation with a physician, psychiatrist or psychotherapist. Test results and recommendations are informational and educational in nature.

8.2. The Operator is not liable for decisions made by the User based on the Platform's materials.

8.3. The Service is provided on an «as is» basis. The Operator makes reasonable efforts to ensure uninterrupted operation but does not guarantee absolute 24/7 availability.

8.4. The Operator's maximum liability to the User is limited to the amount actually paid by the User over the last 3 months.

9. Personal data

9.1. The processing of personal data is governed by a separate Privacy Policy and by the data subject's Consent.

10. Governing law and dispute resolution

10.1. This Agreement is governed by the applicable law.

10.2. All disputes are subject to prior pre-trial settlement by sending a claim to support@wow-brain.com. The response period for a claim is 30 calendar days.

10.3. If no agreement is reached, disputes are resolved in the court at the Operator's location.
